Orange: the member state has signed the Protocol to the African Charter on Human and Peoples’ Rights on the Establishment of an African Court on Human and Peoples’ Rights (“the Protocol”). The Court has jurisdiction to hear cases referred to it by the African Commission on Human and Peoples’ Rights (“the Commission”), from the member state itself, from other member states and from African Intergovernmental Organizations but not from individuals or NGOs.
Purple: the member state has signed the Protocol and the Additional Declaration pursuant to Article 5 (3) and 34 (6) of the Protocol. The Court has jurisdiction to hear cases referred from the Commission, the member state itself, other member states, African Intergovernmental Organizations and, significantly, directly from individuals and NGOs. Please note that for purple countries there still remains requirements that the individual or NGO applicant has exhausted local remedies before the Court can consider the case on its merits.
Green: the member state has not signed the Protocol. The Court has no jurisdiction to hear cases from this member state.
